MenCell Delhi: जब Advocate का अपना पैसा भी Case में लगा हो — फिर वो किसके हित में लड़ेगा?
मान लीजिए आपका property या family dispute चल रहा है।
आपने Advocate को अपना case सौंप दिया।
लेकिन बाद में पता चलता है कि उस dispute में Advocate का अपना financial interest भी जुड़ा हुआ है।
अब दिल में एक सवाल तो आएगा ही—
“वो मेरे लिए लड़ रहा है या अपने पैसे के लिए?”
यह सिर्फ client का emotional doubt नहीं है।
Bar Council of India Rules में professional conduct के तहत कहा गया है कि an Advocate should not act or plead in a matter in which he himself is pecuniarily interested. The rules even give examples involving a lawyer's own financial interest in the subject matter.
अब practical situation सोचिए।
मान लीजिए disputed property में Advocate का खुद कोई financial stake है।
या किसी transaction, recovery या dispute के outcome से Advocate को personally पैसा मिलना या financial loss होना है।
ऐसी situation में client को सिर्फ यह पूछना काफी नहीं है—
“Advocate experienced है?”
एक और सवाल जरूरी है:
“क्या Advocate का अपना पैसा इस dispute के outcome से जुड़ा हुआ है?”
क्योंकि litigation में client चाहता है कि legal advice उसके interests के हिसाब से दी जाए।
अगर Advocate का personal financial interest भी उसी outcome से जुड़ जाए, तो conflict का सवाल उठ सकता है।
और Delhi-NCR में property, matrimonial settlement, recovery और family disputes के दौरान कई बार client को यह भी पता नहीं होता कि background में कौन-कौन से financial relationships मौजूद हैं।
इसलिए अगर आपको किसी Advocate के personal financial connection पर genuine doubt है, तो assumptions मत बनाइए।
Documents देखिए। Transaction history देखिए। Agreements पढ़िए।
और जरूरत हो तो independent legal opinion लीजिए।
एक important distinction भी समझिए:
हर financial relationship अपने-आप professional misconduct साबित नहीं करता।
लेकिन अगर Advocate स्वयं उस matter में pecuniarily interested है, तो professional-ethics rules के तहत उस स्थिति को seriously examine करना चाहिए.

कभी-कभी यह भी देखना पड़ता है—
“मेरे case के result से फायदा किस-किस को होगा?”
क्योंकि अगर आपके Advocate और आपके dispute के बीच कोई personal financial connection है, तो यह बात case आगे बढ़ने के बाद पता चलने से पहले समझ लेना ज्यादा सुरक्षित है।

अगर आपको लगता है कि आपके Advocate का अपना financial interest भी आपके dispute के outcome से जुड़ा हुआ है, तो इसे केवल “शायद ऐसा कुछ नहीं होगा” कहकर ignore मत कीजिए।
क्योंकि जिस व्यक्ति से आप अपने हित की रक्षा की उम्मीद कर रहे हैं, उसके अपने financial interests की clarity भी उतनी ही जरूरी है।
